The PCRM lawsuit is the first to focus on Merck's use of animal-testing data as contributing to the injuries suffered by consumers who took Vioxx. The complaint, which was filed in Atlantic County, New Jersey, alleges that reliance on the animal data was "grossly improper and a violation of Merck's legal and ethical obligations."
Despite having test results "from over 8,000 humans that the drug was killing people," Merck continued to use animal studies to justify continuing to sell Vioxx, said Dr. John Pippin, a cardiologist and consultant to PCRM.

I hope that this sort of suit will make larger and clearer that fact that animal testing isn't a valid method of understanding how drugs apply to humans.
